TERMS OF USE OF GOPAXOS

ACCEPTANCE OF THE TERMS OF USE
KING BYRON IKE manages the website www.gopaxos.com and the web hosting services provided through it (hereinafter “gopaxos”) and any information or data (e.g. photos, texts, availability of accommodation) contained therein (hereinafter “the Material”), in order to provide the users of gopaxos with the possibility to register their accommodation or their business (restaurants, cafes, shops, car rentals, etc.).
The use of gopaxos is subject to these Terms of Use, as in force at any given time, which constitute the agreement between gopaxos and each person using the above hosting services, hereinafter “the User” or “the Users”, or in any way access to the Services and use of them, implies the unconditional acceptance by the User of the Terms of Use, as in force at any given time.
THE WEB SERVICES OF GOPAXOS
Gopaxos is a market place through which accommodation and business owners have the opportunity to list their business and their availability for booking, their price list, photos and general information about their business so that visitors and users of the site can make their accommodation reservations, book restaurants, organize parties, or find out about the opening hours of the shops in the area.
Entrepreneurs wishing to register their business on gopaxos, should fill in a form that will be sent to them following contact with gopaxos , accepting the Terms of Use and the Privacy Policy of the Site. The correctness of these is confirmed by gopaxos in contact with the interested party and then the entrepreneur joins the network of gopaxos’ featured businesses and has his profile on gopaxos, in which his business, cost list, accommodation availability, location, business photos, contact details (email, phone numbers) are displayed.
Users who wish to make a reservation at an accommodation or business, have no obligation towards gopaxos. Their personal information is not stored, and we are not responsible for any subsequent communication with the business. Any use of the personal information they provide to the businesses is at their own risk and according to the terms of the business in question.
Through gopaxos the client can fill in an interest form, which is opened directly by the business and the business will contact the client directly, for the completion of the booking and any details. In the process of requesting the completion of the form the customer, is not obliged to fill in his details for gopaxos. gopaxos, does not keep data basis. The gopaxos is not responsible for the commission of any criminal or disciplinary offences and / or unethical conduct of the business. Also, gopaxos does not set a specific cost for the booking, nor does it have any responsibility regarding the compliance or non-compliance of the operator to adhere to the indicative costs mentioned herein.
The platform is aimed at adults. It is presumed that if the communication is made by a minor, he or she has the consent of his or her parent or guardian, who is the only responsible person. gopaxos does not have the ability to verify the age of each user and assumes no responsibility in this regard.
The questions and their corresponding answers are published in the Questions & Answers section, but also on other pages related to the question, in order to inform other gopaxos users about the same issue. The user who poses the question remains anonymous both when submitting and publishing it, while the answers are signed by the accommodation operator or business, who is solely responsible for the content and accuracy of his/her answer. Gopaxos can in no way guarantee the validity, accuracy, or quality of these. The answers are provided by our partners based only on the questions and data provided by the users, who are the only ones responsible for their accuracy.
The responses from businesses are of an exclusively informative and advisory nature, mainly regarding the booking process and contacting the accommodation or business. If the questions have offensive or abusive content, they will not be sent to the operators, nor will they be published in the Questions and Answers section and other pages related to the question. Questions that refer to businesses by name cannot be handled by gopaxos and accordingly sent to the entrepreneurs for answering. In addition, from questions that contain personal data of the user and do not ensure the anonymity of the user, these extracts will be removed before the question is sent to the doctor and before it is published.
The gopaxos team only answers questions about the service and its use. Once the user submits his question it takes a few days for it to be managed by gopaxos, sent to the operators, answered and published in the Questions & Answers section. gopaxos is not responsible for the timely response of the questions as it is at the discretion of the businesses whether to answer the questions they receive and in what timeframe. gopaxos reserves the right not to manage questions that do not agree with the above terms and the user will be notified by email if their question is rejected.
It is stressed that the answers given by the companies are only aimed at providing general information to the user. Communication through the question submission platform is not a substitute for direct contact with the accommodation or business.
SPECIAL CONDITIONS FOR THE USE OF GOPAXOS
1. The information filled in by users of the gopaxos online services must be provided correctly and accurately. The information provided by the visitor-user for the service of his request is considered confidential and is only passed on to the person directly concerned and to the competent authority or authorities according to the law, in case the use by the visitor is contrary to the rules of use of gopaxos and in general the current Greek legislation. Especially the latter may be considered appropriate when the use of the gopaxos website by a visitor – user violates the rules of operation. The gopaxos does not maintain a database and thus the user-visitor does not need to fill in his personal data on the website.In case of sending data on the gopaxos website, they should not contravene Greek legislation and morals for the use of the Internet in general and should not be altered by the visitor-user who makes the publication or knowingly by others. Each visitor-user is responsible for the use of gopaxos and may use its services only for legal and legitimate purposes. It is not allowed to use gopaxos in a way that could destroy, disable or damage the servers or networks of gopaxos or in ways that interfere with the use and exploitation of the services of gopaxos by any other member-visitor-user. It is also forbidden to the visitor-user to collect or store personal data of other users in any way. The gopaxos reserves the right to seek satisfaction for any damage resulting from the violation of the above prohibitions by the visitor-user and to take any relevant legal action, proceedings and take legal remedial extrajudicial or judicial measures to prevent violation of these terms of use. Despite the fact that our services are made available to the public free of charge, any costs for the booking services provided to users by the partner companies displayed on gopaxos are borne solely by the users and they alone bear the relevant responsibility towards the partner companies. Any dispute or disagreement on the financial transaction concerns only the business and the user and should be resolved without the mediation of gopaxos.
2. The information and presentations provided on market place gopaxos.gr, express the personal views of the authors of the relevant texts, are of an exclusively informative and advisory nature.
3. The visitor – user is considered solely responsible for the personal data that he/she will disclose to the company for his/her reservation and gopaxos bears no responsibility for this process. The gopaxos, does not maintain a data base and its purpose is to communicate directly with the business in question. The user is responsible for the data sent in the form to complete the reservation.
4. The content of the gopaxos website, such as indicatively and not restrictively, the texts, images and information presented by its authors, as well as any other material included in the website is used for the sole purpose of informing and informing its visitors – users. The material and information provided by the website is not exhaustive and may not reflect or be up to date with the latest accommodation and business information. Some of the information on the gopaxos website is provided by third parties. gopaxos is unable to verify this information and does not guarantee its accuracy.
5. gopaxos reserves the right to take any of the following actions, indicatively and not restrictively: a) investigate any complaint in the event that a communication does not comply with the terms and conditions of use of this and decide in its sole discretion to withdraw or require the withdrawal of such communication; b) withdraw communications and data and information sent by the visitor-user, that are considered offensive, illegal or annoying or that do not comply with the terms and conditions of use of gopaxos, d) delete registered members, when they do not comply with the terms and conditions of use of gopaxos after warning them.
6. No information that the visitor – user acquires from gopaxos and its services, does not create any guarantee or obligation of gopaxos, if it is not expressly provided in these terms of use.
7. gopaxos reserves the right to display the data of each businessman/owner of accommodation-restaurant related to his online image on third websites. The right of display comes from any cooperation that gopaxos enters into with other services.
8. gopaxos may provide links to third party websites. It may also select and give priority to specific websites, according to the search terms entered by the visitor – user, allow its advertisers to respond to the search of certain terms with advertisements or with the content of sponsors, according to its Advertising Management Policy. In no case gopaxos does not recommend and does not endorse the content of third-party websites, does not control the availability, content, privacy policy, quality and completeness of the services of other websites and websites to which it refers through “links”, hyperlinks or advertising banners. Thus, for any problem encountered during their visit-use, the user must contact directly the respective web sites and pages, which bear full responsibility for the provision of their services. The gopaxos in no case should be considered, that adopts or accepts the content or services of the web sites and pages to which it refers, that it is linked to them in any other way or that it guarantees them. The gopaxos has no responsibility for any kind of communication of the user-visitor with third parties – service providers advertised on gopaxos and for any transaction that may arise from the relationship between them. The gopaxos is not responsible for the content of third-party websites, websites that are within the framework of the gopaxos website, websites that may appear on the gopaxos website whether it is a search result, or third-party advertisements and does not represent the content or validity. The use of third-party websites is at the risk of the visitors – users and is subject to the terms of use of these websites. Indicatively, gopaxos is not responsible if the websites of third parties:

9. gopaxos does not endorse the content or products or services offered on these sites and is not affiliated with the operators of these sites. Where the Website refers through “links” or hyperlinks to other websites, the owners and / or administrators of these pages bear full (civil and criminal) responsibility for the security, legality and validity of the content of their websites, excluding any liability of gopaxos, such as, but not limited to, liability for violation of intellectual and industrial property rights. If the visitor-user connects to these sites, he bears the sole risk for this connection and access, without any involvement of gopaxos.
10. The gopaxos undertakes the obligation if errors are noted by the visitor – user to make every effort to correct them immediately. However, the visitor uses at his sole responsibility any data and material that are available and contained in this website and provided without any guarantee for their correctness and accuracy and gopaxos bears no responsibility, direct or indirect for any damage (positive or consequential) that may occur to anyone from the use of the website or data contained in it. At any time, without notice to users, gopaxos may make changes and improvements that in its judgment will make it easier to operate the website.
11. Apart from the expressly mentioned exceptions (such as copyright of third parties, partners and institutions), all the content of gopaxos, including images, graphics, photographs, drawings, texts, the services provided and generally all the files of this website, are intellectual property, registered trademarks and service marks of gopaxos and are protected by the relevant provisions of Greek law, European law and international conventions and treaties. Consequently, none of them may be sold, copied, modified, reproduced, republished, edited or “uploaded”, transmitted or distributed in any way to other persons. Excluded is the case of the individual storage of a single copy of a part of the content in a simple personal computer, for personal use only and not for public or commercial use and without deleting the indication of their origin from gopaxos, without affecting in any way the relevant intellectual and industrial property rights. 12. The administrator of gopaxos will not keep a record of users’ personal data on any database.

The visitor – user expressly accepts that the exclusive jurisdiction and competence for any dispute arising with gopaxos, have the Courts of Athens and applicable is the Greek law and when accessing gopaxos from outside Greece. The registration of a business name can continue to be displayed in search engines even after the end of the cooperation with gopaxos by displaying the basic data of name, business address and contact telephone number.
15. The use of the gopaxos website, all services and its content are subject to the above terms of use. If the visitor – user considers these terms unacceptable for him, for any reason, please do not use the gopaxos website. The use of the gopaxos website by the visitor, constitutes full acceptance, consent, consent approval and agreement on behalf of the user, all these Terms of Use and the terms of the Privacy Policy.
MODIFICATION OF TERMS OF USE
gopaxos reserves the right to modify the Terms of Use and any other rules governing the use of the Website at its sole discretion, notifying each time each modification with a relevant announcement on its Website. The Terms of Use will indicate the last date of their update.

gopaxos hereby expressly reserves all intellectual property rights to any and all elements of the Website, as well as to its own Material (and not those advertised through the Website), such as, but not limited to, intellectual property rights, industrial property rights to trademarks of products or services, trade names, distinctive signs, etc.
License Grant – Usage Restrictions
Provided that the User complies with these Terms of Use and with the Privacy Policy of the Website, gopaxos grants to the User a royalty-free, limited, non-exclusive, non-transferable and non-assignable license to access, load, display on the screen of his/her device the Services and the Material and generally use it for the purpose specified in these Terms of Use. In this regard, each User acknowledges and accepts that the Website and the Material are intended for personal and not for commercial use only. OFFICIAL SERVICE
The User agrees not to create or provide ways in which participation in the Service can be carried out from other websites or in a manner not approved by gopaxos.
The User binds and agrees not to use electromechanical computer equipment or software or any other method not approved by gopaxos, which would affect the Website.
AVAILABILITY AND SECURITY
Availability and Smooth Operation
gopaxos makes every reasonable effort for the maintenance and availability of the Website. Users, however, acknowledge that the availability of the Website may be affected by the users’ equipment, other communication networks, internet connection services, the large number of people trying to use the Website at the same time or other causes. For these reasons, Users agree that gopaxos will not be liable for any interruption or malfunction of the Website.
The Website and gopaxos have no connection with the provision of internet connection services and the User and/or the Website Provider remains solely responsible for the payment of all debts to the competent providers of the relevant services and for ensuring his/her access to the internet.
The Users agree and accept that gopaxos may modify and/or temporarily or permanently suspend the operation of all or part of the Website with and/or without notice to the Users. For this reason, gopaxos shall not be liable for any kind of damage due to the interruption of the operation or the malfunction of the Website or the inability of Users to access it, the suspension of all or part of it, the delay, non-delivery, interruption or poor quality of reception of its services or the loss of its content or the existence of any kind of errors. The gopaxos does not guarantee that the Website will be compatible with the device, hardware and software of each User.
SOFTWARE AVAILABLE ON THIS SITE
The intellectual property rights or other rights on the software available for use of the Website belong to gopaxos or its providers/licensors. Although gopaxos makes every effort to protect the Website from digital sons and/or any other kind of harmful or destructive files (or programs) designed to interfere with, destroy or limit the operation of any software or telecommunication equipment, it cannot guarantee that the Website will never be affected by such elements. Therefore, the integrity and preservation of the software systems and equipment of each User is left to his/her own diligence and gopaxos will not be liable in the event of attack on the electronic equipment (software and hardware) of the Users by sons and other harmful files as exposed above.
USER OBLIGATIONS
In addition to what is described in the Special Conditions of Use of gopaxos, Users accept and agree that they will make lawful use of the Website. Users indicatively and not restrictively commit that by using the online services of the Website:
– They shall not act in a way that prevents and/or makes impossible the smooth and/or lawful use of the Website and other linked websites by other users.
– They will not act in such a way as to infringe the intellectual or industrial property rights of gopaxos or third parties.

– They shall not install, promote and/or transmit in any way through the Website digital sons and/or any other kind of harmful or destructive files and/or programs designed to destroy or limit the operation of any software or telecommunication equipment or to prevent other users from using the Website.
– They will not install or promote in any way unsolicited or not expressly approved by gopaxos advertising messages in any form, unsolicited e-mails (spam) and generally will not promote unsolicited information in any way
– They will not “upload” or transmit in any way material and information that they are not entitled to disclose under provisions of law or private agreements (e.g. confidential information)
– They will not act in such a way as to infringe any rights or privacy of others, in particular in such a way as to cause harm to a minor
– They will not interfere with or compromise the security of or otherwise cause damage to the Website, the Material hosted on it, the source code of the software that constitutes it, the server where it is hosted and/or networks connected to or accessible through the Service or other websites connected to it.
– They will not pursue a purpose that is prohibited by these Terms of Use
– Not take any action that could constitute or encourage conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any law
– You will not post or transmit any material that is threatening, untrue, misleading, deceptive, abusive, harassing, harassing, defamatory, obscene, vulgar, immoral, scandalous, pornographic or profane. gopaxos will fully cooperate with all law enforcement authorities and will fully comply with any court order requesting or ordering the disclosure of the identity of any person posting or transmitting such information and material.

It is strictly prohibited to use any element of the Material other than that provided by these terms of use, without written permission of gopaxos. In case of violation of the terms of use, gopaxos will make full use of the remedies provided by law, including criminal prosecution.
VIOLATION OF TERMS OF USE
In any case of violation of the present Terms of Use, Users will be liable to compensation for any positive and/or consequential damage of gopaxos. The non-exercise by gopaxos of its rights arising from these Terms of Use does not imply a waiver of these rights.
Expressly gopaxos reserves the right to supervise the application of these rules at its sole discretion.
COMPENSATION
The User agrees to protect, defend and indemnify gopaxos, its partners, employees and its staff in general for any damage and expense, without limitation, that it may suffer and which results from or is related, directly or indirectly, to the misuse of the Website by the User or to a violation of the Terms of Use.
TERMINATION
gopaxos reserves the right to terminate without prejudice and without any further liability the agreement concluded hereunder with any User immediately and without notice, if the User violates the Terms of Use or part of them or if it fails to confirm information provided by the User in the context of the use of the Website.
ENTIRE AGREEMENT – SEVERABILITY
These Terms of Use together with any other rules to which they refer or which are found on the Service constitute the entire agreement between gopaxos and each User regarding the use of the Website. If for any reason a court of competent jurisdiction finds that any of these Terms of Use is invalid and unenforceable, the validity and enforceability of the remaining terms will not be affected or impaired.
USER RELATIONSHIP WITH GOPAXOS
The User agrees that no representative – represented, agent – represented, cooperation or partnership relationship of any kind or employment relationship is created between him/her and gopaxos as a result of the use of the Website by the User.
MEANS OF EVIDENCE
A printed version of the Website and the Terms of Use and any correspondence in electronic form will be accepted as evidence before judicial or administrative authorities.
These Terms of Use and any modification thereof shall be governed by Greek Law. For any dispute that may arise from this agreement and which cannot be resolved out of court, the competent courts of Athens shall have jurisdiction.
